These Terms of Service ("Terms") govern your access to and use of the CFB Pick'em website, applications, pool-management tools, scoring features, sports information, and related services (collectively, the "Service") operated by CFB Picks LLC, a Georgia limited liability company ("Company," "we," "us," or "our").
By accessing or using the Service, creating a commissioner account, joining a pool, or submitting picks, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service.
You may use the Service only in compliance with applicable law. You are responsible for determining whether your participation in any pool, including any arrangement involving entry fees or prizes outside the Service, is lawful where you are located.
CFB Pick'em is an entertainment and pool-administration service. We are not a sportsbook, gambling operator, payment intermediary, contest sponsor, escrow agent, or custodian of prize funds.
We do not accept wagers, book bets, collect pool entry fees on behalf of commissioners, hold prize money, act as a counterparty to any wager, or pay prizes or winnings.
A commissioner may use the Service to record whether a participant has paid an entry fee directly to the commissioner or another person. Any payment, prize, wager, side agreement, or other financial arrangement among pool participants occurs outside the Service and is solely the responsibility of those participants.
We are not a party to disputes between commissioners and players regarding entry fees, prize distribution, eligibility, pool rules, or other arrangements among participants.
Commissioners may create and administer private pools, invite participants, choose the weekly slate, select contest spreads, open and close pick submission, track participant status, and use other administrative tools made available through the Service.

We may provide default rules or scoring mechanics, but a commissioner remains responsible for the operation of the commissioner's pool.
Commissioners may be required to create an account using an email address and password.
Players generally access a private pool using a pool code or invite link, a pool password, a display name, and a private PIN. A player PIN is intended to authenticate that player's identity within the applicable pool.
You are responsible for maintaining the confidentiality of your credentials, PINs, private invite information, and authenticated sessions. You may not:

Pool scoring and pick-submission mechanics are displayed within the Service and may vary depending on pool configuration.
Unless expressly stated otherwise, each game locks individually at the kickoff time maintained by the Service. After a game locks, selections for that game may not be changed.
You are responsible for confirming that your picks have been saved before the applicable lock time. A browser display, unsaved selection, screenshot, text message, or statement of intended picks does not establish that a pick was successfully submitted.
The Service may permit a player to save an incomplete slate. If a player fails to submit a required pick or confidence value before a game locks, the applicable pool rules and scoring logic will determine the result.
The Service may display game schedules, kickoff times, team information, scores, market lines, and other sports information obtained from third-party sources.
Sports data can be delayed, incomplete, unavailable, corrected, or erroneous. We do not guarantee that third-party sports data will always be accurate, complete, or current.
For pools using against-the-spread scoring, the frozen contest line displayed for the pool is the line used by the Service for contest scoring, even if sportsbook or market lines later change.
Market or current lines shown after a contest line is frozen are informational only unless the Service expressly states otherwise.
We may correct scoring, game data, duplicate records, timing information, or other technical errors when reasonably necessary to apply the applicable pool rules or official game results. Where reasonably practicable, we may maintain an audit trail or communicate material scoring corrections.
We do not guarantee that use of the Service will result in any particular pool standing, prize, financial result, or outcome.
The Service is a technology platform used to administer recreational pools. To the maximum extent permitted by law, we are not responsible for claimed pool winnings, lost prize opportunities, hypothetical winnings, or amounts that a user asserts would have been earned but for an outage, missed submission, data correction, scoring error, or other issue.
The full Service, including advanced statistics, is available without a platform fee for the 2026 season. No payment information is required for 2026 access.
This 2026 offer does not promise that the Service or every feature will remain free in later seasons. Any future pricing, included features and plan duration will be disclosed before they apply.
Except where required by law or expressly stated otherwise, fees are non-refundable once paid. If we discontinue a paid Service materially before the end of the paid period for reasons unrelated to your breach of these Terms, we may provide an appropriate refund or credit in our discretion or as required by law.
Payments may be processed by a third-party payment processor. We do not store full payment-card numbers.
Payment and promotional infrastructure may remain available for future seasons or special contests, but it is not required or displayed for 2026 pools.
Referral codes are intended for genuine referrals. Self-referrals, fabricated accounts, duplicate or abusive redemptions, and attempts to manipulate referral attribution are prohibited. We may reject, reverse, or cancel a referral discount or referral credit associated with fraud, abuse, chargebacks, refunds, or a violation of these Terms.
Unless we expressly state otherwise, referral rewards are promotional account credits, are not cash, have no cash value, are not transferable, and may be subject to eligibility, expiration, or future-purchase restrictions displayed with the program.
You may not use the Service to:
We may investigate suspected misuse and may suspend or terminate access where reasonably necessary to protect users, the Service, or third parties.
The Service, including its software, user interfaces, scoring implementation, graphics, branding, designs, text, and original content, is owned by or licensed to us and is protected by intellectual property laws.
These Terms grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Service for its intended purpose. No other license is granted.
Team names, league names, school names, trademarks, logos, and third-party sports information belong to their respective owners. Reference to a team, school, conference, league, sportsbook, or other third party does not imply endorsement unless expressly stated.
You retain ownership of information you provide to the Service, including pool names, display names, commissioner notes, and other content you submit ("User Content").
You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and otherwise process User Content only as reasonably necessary to operate, secure, support, and improve the Service.
If you provide suggestions or feedback about the Service, you authorize us to use that feedback without restriction or compensation, provided that this does not transfer ownership of your personal information to us.
Our Privacy Policy explains how we collect, use, and disclose personal information and is incorporated into these Terms by reference.
The Service depends on third-party providers for functions such as hosting, databases, authentication, email delivery, payment processing, and sports data.
We are not responsible for outages, errors, delays, changes, or acts of third-party services that are outside our reasonable control. Third-party services may be subject to their own terms and privacy policies.
We may modify, update, suspend, or discontinue all or part of the Service from time to time.
We do not guarantee uninterrupted or error-free availability. Maintenance, internet conditions, cloud-service failures, software defects, sports-data outages, security incidents, or events outside our reasonable control may temporarily affect the Service.
We may make changes necessary to protect security, prevent abuse, comply with law, correct errors, or improve the Service.
You may stop using the Service at any time.
We may suspend or terminate access if we reasonably believe you have violated these Terms, failed to pay applicable fees, created a security or legal risk, abused other users, or interfered with the Service.
Termination does not eliminate obligations or rights that by their nature should survive termination, including intellectual property rights, disclaimers, limitations of liability, indemnification, and dispute provisions.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS, OR THAT SPORTS DATA, SCORES, LINES, KICKOFF TIMES, OR OTHER INFORMATION WILL ALWAYS BE ACCURATE OR CURRENT.
Some jurisdictions do not allow certain warranty disclaimers, so some of the above may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER THE COMPANY NOR ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS; LOST DATA; LOSS OF GOODWILL; LOSS OF USE; OR LOST OR CLAIMED POOL PRIZES OR WINNINGS ARISING OUT OF OR RELATING TO THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO US FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100.
These limitations apply regardless of the legal theory asserted and even if we were advised of the possibility of damages. They do not apply to liability that cannot lawfully be limited or excluded.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless the Company and its owners, officers, employees, contractors, affiliates, and service providers from third-party claims, liabilities, damages, losses, and reasonable costs arising from:

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.
Except for claims eligible for small claims court and except as otherwise required by applicable law, any action arising out of or relating to these Terms or the Service must be brought in the state or federal courts located in Georgia, and you and the Company consent to the personal jurisdiction of those courts.
TO THE EXTENT PERMITTED BY LAW, YOU AND THE COMPANY EACH WAIVE THE RIGHT TO A TRIAL BY JURY IN ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE.
We may update these Terms from time to time. If a change is material, we will provide reasonable notice through the Service, by email where appropriate, or by another reasonable method.
The updated Terms will state their effective date. Your continued use of the Service after the effective date of updated Terms constitutes acceptance to the extent permitted by law.
These Terms and the Privacy Policy constitute the agreement between you and us regarding the Service unless additional terms expressly apply to a particular feature.
If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, reorganization, financing, or sale of all or substantially all of our assets or business.

The Service may use browser localStorage, sessionStorage, cookies, or similar technologies to maintain authenticated sessions, remember pool access during a browsing session, and support essential application functionality.
We use first-party product analytics and advertising measurement technologies to understand site visits, campaign performance, signup and pool-creation funnels, and product usage. These technologies may process page paths, referral source, campaign parameters, browser/device information, event timestamps, time-on-page milestones, scroll depth, sections viewed, and interactions with site navigation and calls to action. We do not record the contents of fields you type for engagement analytics, and we do not sell personal information to advertisers.
If a participant later creates a pool, we may process the referring participant, source pool, new commissioner and associated downstream pool. We use this lineage to understand product growth and prevent attribution abuse. Future promotional fields may be retained but are not presented as a 2026 discount.

Commissioners choose certain information entered into their pools and may independently communicate with or collect information from their participants outside the Service.
This Privacy Policy governs information processed by us through CFB Pick'em. It does not govern information that a commissioner independently collects, stores, or uses outside the Service.
Commissioners should avoid entering unnecessary sensitive personal information into commissioner notes, display names, or other free-text fields.
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information.
No internet transmission, storage system, or security measure is completely secure, and we cannot guarantee absolute security.
You are responsible for protecting your password, PIN, devices, and authenticated sessions and for notifying us if you suspect unauthorized access.
The Service is intended for adults age 18 and older.
We do not knowingly collect personal information through the Service from persons under 18. If you believe a person under 18 has provided personal information to us, contact privacy@cfbpicks.app.
The Service is operated from the United States. If you access the Service from outside the United States, your information may be transferred to, processed, and stored in the United States or other locations where our service providers operate, subject to applicable law.
Because we do not currently use the Service for cross-context behavioral advertising, there is no targeted-advertising opt-out to apply within the Service at this time.
If applicable law requires us to recognize browser-based opt-out preference signals for future processing activities, we will implement appropriate support before engaging in those activities.
